Terms and Conditions
This English version is provided for convenience. The Portuguese version prevails in case of conflict.

These Terms govern access to and use of the website profeciabranda.com (the "Site") and the creator portal hosted on it. By using the Site, you accept these Terms. If you do not accept them, do not use the Site.
1. Who we are
The Site is operated by PROFECIABRAND LDA, registered office at Rua C nº 33, 4480-621 Árvore, Portugal. Contact: collab@profeciabranda.com.
2. Who may use the Site
You may use the Site if you are at least 18 years old. The creator portal is intended for professionals and applicants who have entered or wish to enter into a contract with us.
3. Account and application
Some features — in particular the portal and the /apply form — require true, current, and complete information. You are responsible for safeguarding your credentials and for all activity on your account.
We may refuse applications, suspend or close accounts that breach these Terms, violate the law, or harm the integrity of the platform.
4. Creator contract
The contractual relationship between you and PROFECIABRAND LDA as a creator is governed by the specific contract you signed at /portal/contract, not by these Terms. In case of conflict between these Terms and the creator contract, the creator contract prevails.
5. Content and intellectual property
The texts, images, trademarks, logos, and code of the Site are owned by PROFECIABRAND LDA or licensed to us, and are protected by copyright and industrial-property rights. You may not reproduce, distribute, or create derivative works without our prior written consent.
You retain ownership of the content you send us (for example, in your application). You grant us a non-exclusive, worldwide, royalty-free licence to use it solely for the application-evaluation and contract-management purposes described in the Privacy Policy.
6. Prohibited conduct
You agree not to:
- Access the Site through unauthorised automated means, except public crawling that respects robots.txt;
- Attempt to circumvent authentication, authorisation, or rate-limiting mechanisms;
- Upload unlawful or defamatory content, content that infringes third-party rights, or content containing malicious code;
- Use the Site to send unsolicited commercial communications to third parties.
7. Third-party links
The Site may contain links to sites and services operated by third parties. We do not control those sites and are not responsible for their content, policies, or practices. You access them at your own risk.
8. Disclaimer
The Site is provided "as is" and "as available". Without prejudice to your mandatory consumer rights, we do not warrant that the Site will operate uninterrupted or error-free, nor that it will meet any specific expectations not contractually agreed.
9. Limitation of liability
To the maximum extent permitted by law, PROFECIABRAND LDA is not liable for indirect damages, lost profits, lost data, or lost opportunity arising from your use of the Site. The limitations in this clause do not apply in cases of wilful misconduct, gross negligence, personal injury, or where mandatory law prevents them.
10. Governing law and jurisdiction
These Terms are governed by Portuguese law. Any dispute arising from use of the Site is subject to the courts of the Porto judicial district, with express waiver of any other forum, without prejudice to mandatory consumer-protection rules that grant the consumer the forum of their domicile.
Alternatively, you may use an authorised consumer alternative-dispute-resolution body. The official list is at www.consumidor.gov.pt.
11. Changes to these Terms
We may update these Terms. The version in force is always the one published on this page, identified by the last-updated date. Continued use of the Site after an update means acceptance of the new version.
